The short version. Your data stays yours and we will not use it for anything but running the product for you. The software stays ours. This is early software offered without a service level, so check its numbers before you act on them. Either of us can end this at any time, and if we end it you get your data out first.
Who this is with
These terms are between you — or the organisation you are signing up on behalf of — and Beehive Reporting d.o.o., registered at Savski gaj III. 15, Zagreb, Croatia ("we", "us"). Creating an account means you accept them. If you are accepting for an organisation, you are confirming you are allowed to.
Who may use it
Orkestar is a business tool. It is not offered to consumers or to anyone under 16. You need an email address you actually control, because it is how we identify you and how you recover the account if you lose your password.
Your account
Keep your password to yourself and tell us at support@orkestar.eu if you think someone else has it. Anything done through your account is treated as done by you. Do not share one login between several people — invite them instead, so the audit trail means something.
Free tier, trial and paid plans
A new account starts on a 14-day trial with no payment card. The trial is the analytics module — the same module the free tier keeps — with formula-live Excel export switched on and seats for a small team: 2 builder and 3 viewer seats, against a single seat on the free tier. Signing up does not open the planning modules (Plan, Perform and Strategy); those are enabled for a customer we have agreed terms with, never by a signup. When the trial ends nothing is deleted: the account moves to a free tier with no expiry date that keeps the analytics module and everything you have uploaded to it. The Excel export and the teammates' access end with the trial.
The free tier carries fair-use limits so one account cannot crowd out the rest — currently 100 datasets per workspace; 64 MB, 500,000 rows and 512 columns per uploaded file; 300 MB per Excel file once decompressed; and 30 upload requests an hour per signed-in user, of which uploading a file and applying its column mapping each spend one.
An account on the free tier that nobody signs into for around eleven months is warned by email and, if it is still untouched 30 days later, has its uploaded data cleared. The account itself survives and you can upload again. Signing in at any time before that cancels it. This is described in full under retention.
Nothing is charged without you entering payment details and agreeing the price first.
Your data is yours
You keep every right in the data you upload and everything the product derives from it. We claim no ownership of it. We use it only to run the service for you, as described in the data processing statement. We do not sell it, we do not share it with advertisers, and we do not use it to train models or build anything another customer sees.
You are responsible for having the right to upload what you upload — including where the file contains personal data belonging to your customers or staff.
Our software is ours
The product, its code, its designs and its name remain ours. Using it gives you a limited, non-exclusive, non-transferable right to use it while your account is open, and nothing more. Do not copy it, resell it, rent it out, reverse-engineer it, or use it to build a competing product.
If you send us feedback we may act on it freely and without owing you anything for it. That is not a claim over your data — only over ideas you volunteer about the software.
Acceptable use
- Do not upload malware, or content you have no right to.
- Do not try to reach another customer's workspace, or probe for a way to.
- Do not attack the service — load-testing, scraping at volume, or bypassing rate limits.
- Do not use it to break a law, or to process special-category personal data it is not built for.
- Security research is welcome. Report what you find to support@orkestar.eu before you publish it, and do not use another customer's data to demonstrate anything.
Availability, and what this software is
This is early software under active development. Features change, and screens you use may move. There is no uptime commitment and no service level unless one is agreed in writing with a paid plan.
Orkestar produces analyses, plans and statements from figures you supply. It is a tool, not an accountant and not an auditor. Check its output before you file it, publish it, or act on it. You remain responsible for the decisions you make and for anything you report to a third party.
Ending it
You can stop at any time: ask us to close the workspace and we erase it as described under deleting your data. Any paid period already invoiced is not refunded pro rata unless the law says otherwise.
We can suspend or close an account that breaches these terms, that is being used to attack or endanger the service, or where we are required to. Except where a breach makes it impossible, we give notice first and a reasonable chance to get your data out.
We can also end or change the service, or a tier of it, without cause — with at least 30 days' notice by email to account holders, and always with the chance to export your data first.
Warranties and liability
We provide the service with reasonable skill and care. Beyond that, and to the extent the law allows, it is provided as it is: we do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose of yours.
Neither of us is liable to the other for indirect or consequential loss, lost profits, lost revenue, or loss of anticipated savings. Our total liability in any twelve-month period is limited to what you paid us in that period — which on a free account is nothing.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, for fraud, or for breaches of data protection law where the law fixes the position regardless of contract.
Changes to these terms
We may update these terms. If a change materially affects your rights we will email account holders at least 30 days before it takes effect, and continuing to use the service after that date means you accept it. If you do not, close the account and take your data with you.
Law and disputes
These terms are governed by the law of Croatia, and the courts of Zagreb, Croatia have jurisdiction. Nothing in this clause removes a protection the law of your own country gives you where it applies regardless.
